These Terms and Conditions regulate access and use of the website www.shop-biota.pt (hereinafter referred to as the Internet Site), owned by BIOTA - ESTUDOS E DIVULGAÇÃO EM AMBIENTE LDA, (hereinafter referred to as “BIOTA”), with NIF 508342961, and with an address at ABC-Apoio de Base à Criatividade -Convento de São Miguel das Gaeiras - 2510-718 Gaeiras - P ortugal , as well as the conditions of sale of services and products offered by BIOTA on its website.
As a BIOTA User, you must fully accept these conditions of use, as well as the different modifications and/or additional legal texts that BIOTA may include in the future.
2. User Data and Conduct on the Website
In order to purchase the products offered through the Website, Users may choose between:
- Register in advance: the User can register by filling out the form that is hosted on the Website. The required data (name, surname, email address, telephone number) is requested in order to process orders and keep the User informed about the order process.
- Buy without registering: the User can make a purchase without identifying themselves in advance. During the purchase process, the User must provide BIOTA with the billing and shipping details necessary to receive the order.
The User must prove that their data is correct and complete and inform BIOTA when there is any change or modification in the information provided during the purchase process.
The use of the Website for fraudulent purposes or in connection with criminal offenses or illicit activities of any kind is not permitted.
It is also prohibited to send, use or reuse illegal, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or that involves a violation of copyright, trademarks or confidentiality, privacy or any other right, or of any in a way that is offensive or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising, chain emails or any other type of “spam” and, in general, any type of unnecessary annoyance or inconvenience.
The User undertakes to make lawful, diligent, honest and correct use of all information and content that they access through the Website, in accordance with the principles of good faith and with respect at all times for legality. current.

3. Orders and sales conditions
To make a purchase, the User must be over 14 years old, or, otherwise, must obtain prior authorization from their parents, guardians or legal guardians, who will be responsible for all actions carried out through the Website by minors in their care.
BIOTA places orders for Portugal (including the islands).
In no case will BIOTA intentionally offer for sale more units than it has available. If the product is not available after placing the order, the User will be informed by email or telephone, offering the possibility of postponing delivery, exchanging the product for a similar one or refunding the amount paid.
4. Prices and payment methods
All product prices indicated on the Website are expressed in euros and include VAT and other taxes that may apply.
BIOTA offers two shipping methods and, as such, two different delivery times (see section 6.2):
- Standard Shipping: shipping will be completely free on purchases over 50 euros.
- CTT Shipping: the User must pay an additional 3.95 euros to the total purchase, when it is less than €50.
The User must pay the amount corresponding to their order via credit or debit card (Visa, Mastercard), via bank transfer, ATM or MBWay.
Once the order has been formalized, that is, after acceptance of these Terms and Conditions and payment of the order, BIOTA will always send an email to the User confirming the details of the purchase made and the corresponding invoice or receipt.
Users are guaranteed that the payment process is carried out in complete security, in accordance with the required security protocols and services.
The User must notify BIOTA of any undue or fraudulent debit on the card used for purchases, through the “Contact us” section of the Website or by sending an email to info@biota.pt, within the shortest possible time to so that BIOTA can take the necessary actions.
5. Information about BIOTA products and services
The data included on the Website in product descriptions has a purely informative function.
6. Deadlines, delivery locations and losses
6.1. Product delivery
BIOTA undertakes to deliver the product in perfect condition to the address indicated by the User. In order to optimize delivery, we would like to thank the User for indicating an address to which the order can be delivered within normal working hours.
To avoid incidents during delivery (wrong addresses, impossibility of contacting someone at the address, etc...), it is essential to fill out the respective form correctly, and it is mandatory to fill in the field corresponding to the contact telephone number (a cell phone is recommended).
BIOTA will not be responsible for delivery errors when these are due to the fact that the address entered on the form by the User does not correspond to reality, is false or has been omitted.
Without prejudice to the foregoing, BIOTA undertakes to adopt the measures within its reach so that the delivery of orders can be carried out within the agreed time or, if this is not possible, so that it can be carried out as quickly as possible.
6.2 Delivery and notification deadline
BIOTA offers two shipping methods and, as such, two different delivery times:
- Normal Shipping: the delivery time for the order in the peninsular territory will be 3 to 4 working days from the moment the User receives confirmation of purchase of the order.
- CTT shipping: the delivery time for the order in the peninsular territory will be 5 to 6 working days from the moment the User receives confirmation of purchase of the order.
If the User made their purchase by bank transfer or ATM, the product delivery period will begin on the business day following confirmation of the order value entering the BIOTA account.
Notwithstanding the foregoing, customers are informed that the stipulated delivery dates will be estimates.
BIOTA informs that it will not be possible to send orders to PO Boxes.
BIOTA will not make deliveries or shipments on Saturdays and Sundays, nor on national or municipal holidays.
If it is not possible to locate the User at the indicated address, the transport company will, whenever possible, leave a notice indicating where the order is located and how to collect it.
6.3 Due diligence in delivery
The User must prove the good condition of the package to the courier who delivers the requested order. If it is not in good condition, it is important to have photos for your assessment and subsequent complaints to the transport companies.
If the customer detects any anomaly in the product, they must indicate this on the delivery receipt and notify BIOTA via email: info@biota.pt.
BIOTA informs the User that the transport company has taken out insurance that covers the risks of loss or damage to the product.
7. Returns and right of withdrawal
7.1. Returns due to manufacturing defects
All products offered through the Website will be completely original, unless otherwise indicated in the description. They all have a 14-day warranty period from receipt of the product.
During the warranty period, the User may return to BIOTA , free of charge, any product that presents a manufacturing defect. To formalize the return, the User must contact BIOTA, via email at info@biota.pt , indicating the product or products subject to the return, detailed information on the defects found in them and attaching the photograph. After receiving this communication, BIOTA 's customer service team will manage the collection of the defective product for shipping to our warehouses, at no cost to the User.
In the event of a defective product, BIOTA will, as necessary, repair, replace, reduce the price or terminate the contract, actions that will be free of charge for the customer.
Each product to be returned must be unused and with all labels, packaging and, if applicable, documentation and original accessories that came with it. If the User does not do so, BIOTA reserves the right to refuse the return.
Once the product has been received, BIOTA will refund the corresponding amounts paid as quickly as possible.
7.2. Withdrawals and returns
If the User wishes to make an exchange or return, they must send an email to info@biota.pt.
Each product to be returned must be in perfect condition, unused and with all labels, packaging and, if applicable, documentation and original accessories that came with it. If the User does not do so, BIOTA reserves the right to refuse the return.
Once the product has been received, BIOTA will refund the corresponding amounts paid, as quickly as possible and, in any case, within fourteen (14) days following receipt of the product in BIOTA 's warehouses.
8. Intellectual and industrial property
All rights over the content, design and source code of this Website and, in particular, with an enunciative but not limiting nature, over the photographs, images, texts, logos, designs, brands, commercial names, data that are included on the Website on the Internet and any other intellectual and industrial property rights are the property of BIOTA , which has the exclusive exercise of the rights to exploit them, or, if applicable, BIOTA has a license or authorization from the authors.
BIOTA does not grant any license or authorization to use any class of its intellectual and industrial property rights or any other property or right related to the Website, and in no case will it be understood that the User's access and navigation implies a total or partial waiver, transmission, license or assignment of said rights by BIOTA .
Any use of these contents not previously authorized by BIOTA will be considered a serious breach of intellectual or industrial property rights and will give rise to legally established responsibilities.
